Welcome to Baby Blake's® Bedtime. These Terms of Service ("Terms") are a legal agreement between you and ISG Gaming LLC ("we," "us," "our") and govern your use of the Baby Blake's® Bedtime app, website, and related services (collectively, the "Service").
By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Baby Blake's® Bedtime is a children's app intended for use by children with the active supervision of a parent or legal guardian. Before use, every visitor must solve a parental verification gate (a simple math problem). By solving the gate, you confirm that you are at least 18 years old and that you are the parent or guardian of any child who will use the App.
If you are under 18, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms on your behalf.

Baby Blake's® Bedtime generates short, age-appropriate bedtime stories using artificial intelligence ("AI") for the text and synthesized narration for the audio. You select preferences (such as a child's first name, theme, length, age range, and narrator voice), and the Service produces a story based on those choices.
The stories are generated dynamically by AI models (currently Anthropic's Claude API) and are not pre-written or curated by us. While we have designed the Service to produce age-appropriate content and apply prompt engineering to keep output suitable for children, AI systems can occasionally produce unexpected output. You should always review content alongside your child and use your judgment as a parent or caregiver.
This App is intended to be used by parents and guardians for and with their children. As the supervising adult, you are responsible for:

We reserve the right to suspend or terminate access if these terms are violated.
When entering custom story themes, character names, or other free-form input, you agree not to submit content that is inappropriate, offensive, or harmful. We may apply automated and manual review to user inputs to detect and block prohibited content. ISG Gaming LLC reserves the right to block or filter any input that violates these Terms.
When you generate a story through the Service, the resulting text and audio (the "Generated Content") is created by AI models on your behalf.
Subject to these Terms, you may use Generated Content for personal, non-commercial purposes — for example, listening to a story with your child, saving it to your device, or sharing a favorited story through the app's sharing feature, which creates a link that expires after 7 days.
You may NOT:
We retain all rights to the Service itself, including the App, our brand, our designs, and the systems that produce Generated Content. We may use anonymized, aggregate data about how the Service is used (for example, popular themes) to improve the product.
AI-generated content is probabilistic and can occasionally produce errors, factual inaccuracies, or unexpected results. We do not guarantee that Generated Content will always be accurate, appropriate for every child, or free from errors. Parents and guardians are responsible for reviewing content before sharing it with children.
The Service uses third-party providers (including Anthropic, ElevenLabs, Google Play, Vercel, Upstash, Cloudinary, Resend, and Discord) to deliver its features. These providers operate under their own terms and privacy policies. We are not responsible for the practices, content, or availability of these third-party services. See our Privacy Policy for details on what information we share with each provider.
Baby Blake's® Bedtime includes 2 free personalized stories per account. After that, you can buy additional story credits through in-app purchase. We currently offer three credit packs (1, 5, and 10 stories).
On Android, purchases are processed by Google Play Billing. We do not receive, see, or store your credit-card or banking information — the app store handles all payment details and sets the prices, taxes, and refund eligibility under its own terms. On iPhone and iPad, purchases are processed by the Apple App Store in exactly the same way, under Apple's own terms.
Story credits are tied to an anonymous account created for your device, and a one-time recovery code lets you restore purchased credits to a new device. Credits have no cash value, are non-transferable, and are not redeemable for money except where required by law. You can request deletion of your account at privacy@babyblake.io; note that deleting it also removes any unused credits, which cannot be restored afterward. We may change pricing or the available credit packs at any time, with reasonable notice.
The Service, the Baby Blake's® Bedtime name and brand, the App's design, code, artwork, and all related materials are the property of ISG Gaming LLC or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
"Baby Blake's®" is a trademark of ISG Gaming LLC.
You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission, except as expressly permitted by these Terms or by law.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge and agree to the data practices described there.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

You use the Service at your own discretion and risk.
Exclusion of Consequential Damages. To the fullest extent permitted by applicable law, in no event will ISG Gaming LLC, its founders, members, employees, contractors, agents, or affiliates (collectively, the "ISG Parties") be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with these Terms, the Service, any AI-generated content, or any inability to use the Service, regardless of the theory of liability (whether in contract, tort, strict liability, or otherwise) and even if any ISG Party has been advised of the possibility of such damages.
Direct Damages. To the fullest extent permitted by applicable law, the total aggregate liability of the ISG Parties for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amounts you have actually paid to ISG Gaming LLC in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) twenty United States dollars (US $20.00).
Basis of the Bargain. You acknowledge and agree that ISG Gaming LLC has offered the Service and entered into these Terms in reliance upon the limitations of liability and disclaimers of warranties set forth herein, that the same form an essential basis of the bargain between you and ISG Gaming LLC, and that ISG Gaming LLC would not offer the Service or enter into these Terms absent such limitations and disclaimers.
Carve-Outs. Nothing in this section shall limit or exclude: (a) liability for death or personal injury caused by negligence; (b) liability for fraud or fraudulent misrepresentation; (c) any liability that cannot be limited or excluded under applicable law, including any mandatory statutory consumer-protection rights in your jurisdiction; or (d) your indemnification obligations under these Terms.
AI Content Acknowledgment. You expressly acknowledge that AI-generated stories may occasionally contain content that is imperfect, unexpected, inconsistent, or unsuitable for your particular child's age, temperament, or sensitivities. You assume full responsibility for reviewing all generated content before or during your child's exposure to it and for determining its suitability for your child. ISG Gaming LLC does not guarantee the accuracy, quality, safety, or appropriateness of any AI-generated output for any particular child or use case.
No Liability for Third-Party Providers. The ISG Parties shall not be liable for any acts, omissions, outages, errors, data practices, or service interruptions of any third-party service provider, including without limitation Anthropic, ElevenLabs, Google Play, Vercel, Upstash, Cloudinary, Resend, or any Platform through which you access the Service. Your sole remedy for issues arising from third-party services lies with the applicable third-party provider under its own terms.
You agree to indemnify and hold harmless ISG Gaming LLC, its officers, employees, and contractors from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:
You may stop using the Service at any time by uninstalling the App or clearing your browser data.
If you have purchased story credits, they are held in an anonymous account; you can request deletion of that account and any unused credits at privacy@babyblake.io.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, abused the Service, or for any legitimate business reason.
Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
We may modify, update, or discontinue features of the Service at any time. We may also update these Terms from time to time. When we do, we will:
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.
Any disputes arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
